after termination of Dev. acc. does Apple return funds earned?

Apple has just sent me a notice of Termination, saying that I breached conditions of Developers Agreement. I have read the forums and found out that apealing to such decision makes no sense.

The question is: in that case does Apple give back amounts of money earned by the developer but unpaid yet? I have a pending some of about 10k $ there so it's really a big issue.

I have read the Developers agreement but found nothing about it. If it is written there, can anyone point me the clause?
